TERMS AND CONDITIONS

MPHQ Membership Terms & Conditions

About These Terms

These Terms & Conditions apply to all MPHQ memberships, class passes, group Reformer Pilates sessions, private sessions, workshops and studio activities. By purchasing or using an MPHQ service, creating an account, signing electronically or attending the studio, you confirm that you have read and agree to these terms.

MPHQ provides group Reformer Pilates and related movement experiences. MPHQ is not a medical, allied-health or clinical facility and does not diagnose, treat or provide medical advice.

Membership Options & Pricing

All memberships are personal to the member and may not be shared or transferred without MPHQ’s written approval.

Reserve includes priority booking and priority waitlist access, plus first preference for eligible challenges, club workshops and selected limited-capacity experiences. Priority access improves booking preference but does not guarantee a place in any particular class, workshop or event.

Membership Term, Billing & Cancellation

All memberships have a minimum commitment of 4 weeks. After the minimum commitment, the membership continues on an ongoing basis until cancelled in accordance with these terms. There is no fixed 12-month commitment unless a separate written offer expressly states otherwise.

Membership fees are billed fortnightly in advance from the member’s commencement date. Members authorise MPHQ and its payment provider to process recurring payments using the nominated payment method.

To cancel a membership, the member must provide 30 days’ written notice by email to info@mphq.club. A cancellation request may be submitted during the minimum commitment; however, cancellation will take effect on the later of the end of the 4-week minimum commitment or the end of the 30-day notice period.

Membership payments and access continue during the notice period. Any scheduled payment falling within that period remains payable, with MPHQ adjusting the final payment where required to avoid charging beyond the cancellation date.

Requests to change a regular billing date may be submitted to the studio. MPHQ will try to accommodate the request but cannot guarantee that every billing-date change will be possible.

Failed Payments

Members must keep their payment details current and ensure sufficient funds are available. If a payment fails, MPHQ may retry the payment, contact the member, suspend membership access and cancel upcoming bookings until the account is brought up to date.

MPHQ will not continue debiting membership fees after an effective cancellation date, except for amounts that became payable before cancellation.

Weekly Sessions, Credits & Expiry

For The Ritual and The Signature, a membership week is each recurring 7-day period beginning on the member’s original membership start day. Two membership weeks make up each fortnightly billing cycle.

Ritual and Signature sessions must be used within the applicable membership week. Unused sessions do not roll over, accumulate, convert to cash or transfer to another person.

Reserve provides unlimited eligible group sessions but remains subject to class capacity, the published timetable, booking availability, cancellation requirements and fair use of limited studio places.

Class passes, introductory offers and promotional credits have the validity period shown at purchase. Expiry periods will not be extended for change of mind, non-attendance or unused sessions, except where required by law or expressly agreed by MPHQ.

Timetable, Availability & Studio Direction

MPHQ operates a curated timetable designed to provide a premium, limited-capacity group experience. A membership provides access to book eligible sessions; it does not guarantee a particular day, time, instructor, class format or minimum number of classes on the timetable.

MPHQ may reasonably change class times, operating days, instructors, class formats or the timetable in response to attendance, demand, staffing, safety and operational requirements. MPHQ will provide reasonable notice of material ongoing changes where practicable.

When demand supports expansion, MPHQ may add sessions to established shifts. Instructor substitutions may occur without prior notice.

Bookings, Waitlists & Attendance

All bookings must be made through the MPHQ App or website. Members are responsible for checking that their booking details are correct.

Bookings may be made up to 14 days in advance, unless MPHQ publishes a different booking window for a particular membership, event or offer.

Waitlist places are offered according to the studio’s booking system and membership priority rules. Members are responsible for monitoring notifications and managing any booking received from a waitlist.

New clients must arrive at least 10 minutes before their first class. Returning clients must arrive at least 5 minutes before class. Members should allow sufficient time for parking and traffic.

Late entry may be refused where it would disrupt the class, prevent completion of the safety briefing or create a safety risk. If entry is refused due to late arrival, the session will be treated as a late cancellation.

Cancellation & No-Show Policy

Group Reformer Pilates sessions must be cancelled or rescheduled through the MPHQ App at least 6 hours before the scheduled start time. A cancellation made inside 6 hours, a no-show or a late arrival refused entry will result in loss of the session credit for Ritual, Signature, passes and packs.

Reserve members must also comply with the 6-hour cancellation policy. Repeated late cancellations or no-shows may lead MPHQ to contact the member and, after reasonable notice, temporarily restrict advance booking privileges to protect access for other members.

Private sessions require at least 24 hours’ notice. A private session cancelled inside 24 hours or missed without notice will be forfeited and charged in full.

MPHQ may cancel or reschedule a class when reasonably necessary. Affected members will be notified as soon as practicable and any session credit used for the cancelled class will be returned. Any further remedy will be provided where required under the Australian Consumer Law.

Studio Experience & Conduct

Classes are limited to a maximum of 11 participants to support quality coaching, personalised guidance and a calm studio environment.

All classes run for approximately 50 minutes unless a different duration is stated for a particular class, workshop or event.

MPHQ is a phone-free movement space. Before entering the movement area, all phones must be completely switched off—not placed on silent—and left in the designated storage area or pigeonholes. Phones must never be kept beside, underneath or attached to a reformer bed. This policy protects the calm studio environment and prevents calls, alarms, notifications or vibrations from disturbing the class. Members must not use phones, take calls, film, photograph or message during a session. Any genuine medical, accessibility or emergency requirement must be discussed with the instructor before class.

Grip socks are mandatory for hygiene and safety. Grip socks may be purchased from the studio if required.

Members must treat staff, other members, equipment and the studio respectfully; follow reasonable staff directions; and avoid conduct that is unsafe, disruptive, abusive, discriminatory or inconsistent with the MPHQ environment.

Members must clean their reformer and any shared equipment after use in accordance with instructor directions.

MPHQ may refuse entry or suspend access where reasonably necessary for safety, serious misconduct, repeated policy breaches or non-payment. MPHQ will act reasonably and communicate the reason and next steps to the member.

Health, Injuries & Participation

Reformer Pilates is physical exercise and carries inherent risks, including the risk of strain, falls or injury. Members must participate within their own ability, follow instructor directions and stop immediately if they experience pain, dizziness, faintness, shortness of breath or unusual discomfort.

Before each session, members must tell the instructor about any injury, illness, surgery, medical condition, pregnancy, change in health or other issue that may affect safe participation. Members consent to MPHQ recording relevant health, injury, goal and modification notes in their member profile for safety and service delivery.

MPHQ may require medical clearance, recommend a private session, provide modifications or decline participation where staff reasonably believe group exercise may not be appropriate or safe. Members should seek independent medical advice if unsure whether they can safely participate.

Pregnancy

Pregnant clients must contact MPHQ before booking or attending and inform the instructor before every session.

Written clearance from a doctor or appropriately qualified healthcare professional is required for participation during pregnancy. MPHQ may request updated clearance if circumstances change.

After 12 weeks of pregnancy, participation is permitted only where the class is considered suitable, the required clearance has been provided and the client can safely follow the instructor’s pregnancy modifications.

Clients who are new to Reformer Pilates during pregnancy may be asked to complete a private session before joining a group class.

Age Requirements

Participants must be at least 13 years old. Anyone under 18 must contact MPHQ before attending and provide consent from a parent or legal guardian. MPHQ may require a parent or guardian to complete the account, waiver and relevant health information.

Photography, Filming & Media Consent

MPHQ may photograph or film selected classes, events and studio activities for social media, advertising, website, educational and club-content purposes.

Media consent is voluntary and will be requested separately from general membership acceptance. Choosing not to consent will not prevent a person from becoming a member or attending classes.

Members who have not consented, or who withdraw consent, should also notify the studio before a filmed class or event so MPHQ can take reasonable steps to exclude them from identifiable content.

Consent may be withdrawn prospectively at any time by contacting info@mphq.club. Withdrawal applies to future capture and future use where reasonably practicable, but may not allow MPHQ to retrieve content already lawfully published, distributed or incorporated into completed materials.

Privacy & Member Information

MPHQ collects and uses personal information, including relevant health information, to manage memberships, bookings, payments, safety, member communication and service delivery. MPHQ will handle personal information in accordance with applicable privacy law and its privacy practices.

Members must keep their contact, emergency, payment and relevant health information accurate and current.

Purchases, Refunds & Transfers

MPHQ does not provide refunds or extensions for change of mind, failure to attend, unused sessions, booking errors or a change in personal circumstances, unless MPHQ expressly agrees otherwise.

Memberships, passes, sessions, offers and promotional purchases are personal and non-transferable unless MPHQ gives written approval.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where those rights apply, MPHQ will provide the remedy required by law.

Personal Property

Members are responsible for belongings brought into the studio. To the extent permitted by law, MPHQ is not responsible for loss, theft or damage to personal property unless caused by MPHQ’s failure to exercise reasonable care.

Risk, Responsibility & Liability

By participating, members acknowledge the inherent risks of physical exercise and voluntarily choose to participate. Members are responsible for providing accurate information, following reasonable safety instructions and exercising within their personal capacity.

To the extent permitted by law, MPHQ is not liable for loss, damage or injury arising from a member’s failure to disclose relevant information, failure to follow instructions, misuse of equipment or participation beyond their capacity.

Nothing in these terms excludes or limits liability, consumer guarantees or other rights that cannot lawfully be excluded or limited. MPHQ will provide its services with the care and skill required by applicable law.

Contact & Notices

Membership cancellations, media-consent withdrawals and formal membership enquiries must be sent to info@mphq.club. Members are responsible for keeping their email address and mobile number current and for reviewing notices sent by MPHQ.

Acceptance

By purchasing or using an MPHQ membership, pass or service, the member confirms that they have read, understood and agree to these Terms & Conditions, including the membership, billing, cancellation, booking, health and studio-conduct requirements.
